My automobile was behind finished 2 weeks behind as well as a alternative guys word association told me yesterday which it will be totalled. They will cut me a check for kbb worth of my automobile as well as will yield a let automobile for only an additional week. we feel which is as well reduction to find a latest automobile as well as they should atleast magnify a let by a single some-more week. is there any approach i can competition this? have been there any law requiring them to cover let for some-more than 1 week in these situations?

This is completely up to the insurance company and once they have said that it is a total lost then one more week is fair but they should have notified you a lot earlier but remember that you are dealing with the other party’s insurance……..
Usually for one or two days after they cut the check for the total.
A whole week is generous. You’re not going to be able to contest it. No, they don’t even have to cover it for a full week – technically, the second they hand over the check to you for your car, they don’t have to pay for any more rental.
You must have got on to them pretty good for them to extend the rental for a full week. Did you threaten to sue them? Did you complain about injures? It sounds like they are trying to butter you up. You can always ask if they’ll extend the rental and see what they say. You have nothing to lose. I’m surprised they’re giving you the full kbb value? They normally don’t do that (they normally give what’s called the fair market value). What company is this by the way?
thank you lucky stars for the 1 week extension.
i have worked for 4 different insurance companies and the most time allowed was 3 days. one said your car is totaled and turn your car in today. the person did not even have his check to purchase another vehicle but had to wait 2 to 3 days to receive. the average is 2 to 3 days.
so no they will not extend it. most people dont realize how much rental costs the company. usually when they are looking for ways to cuts costs, they will look 1st at rental.
the main reason for doing this is to force you to get out and start looking. otherwise, people could say, well i am going to wait till next month when they do their promotions and rebates etc. when you are not paying for it, you feel there is no hurry. but if you were out of pocket, you would be inclined to find something asap.
good luck
They only have to give you a rental car (if they do that at all) during the time you are without a car if it’s being repaired in a shop, or until they settle with you if it’s a total loss. If they are giving you a week beyond settlement, they are being very very generous. Push them and demand it for a longer time, and they could end it immediately.
As an aside, you won’t get a check for KBB value for your car, and I doubt they said that. They will give you fair market value, which has nothing to do with KBB.
The insurance company only owes you a rental car until they make you a reasonable offer. They don’t owe you until you get a check in hand. They don’t owe you a rental until you accept their offer. Only until they make a reasonable offer to you – regardless if you accept it.
If they are providing a car longer than that…they have gone beyond their legal obligation. They would have been fully with in their rights to say…”we made you an offer today, turn that car in by 5.”
They have told you your car is a total loss. So get out and start looking for a replacement. If you want to take 2 weeks to find a replacement car…that’s your choice and your expense.
In the mean time….stop messing around with YA and start searching your local classifieds, autotrader.com, cars.com, carmax.com.
